ข้อกำหนดและเงื่อนไขการใช้งานสินทรัพย์ดิจิทัล

1. สิทธิ์ในการใช้งานเชิงพาณิชย์

ผู้ใช้งานสามารถนำ Asset ที่ดาวน์โหลดจาก TDMesh ไปใช้ในงานส่วนตัว งานลูกค้า และโครงการเชิงพาณิชย์ได้ รวมถึงการผลิตสื่อโฆษณา วิดีโอ แอนิเมชัน เว็บไซต์ เกม สื่อการเรียนรู้ และผลิตภัณฑ์สำเร็จรูปที่สร้างขึ้นจาก Asset ดังกล่าว

2. ข้อห้ามในการขายต่อและแจกจ่ายไฟล์

ห้ามนำ Asset ที่ดาวน์โหลดจาก TDMesh ไปขายต่อ ให้เช่า แจกจ่าย หรือเผยแพร่ต่อในรูปแบบไฟล์ต้นฉบับ ไม่ว่าจะเป็นการดำเนินการทั้งหมดหรือเพียงบางส่วน โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจาก TDMesh

3. ห้ามรวบรวม Asset เพื่อจำหน่ายซ้ำ

ห้ามนำ Asset หลายรายการหรือหลายไฟล์มารวบรวม จัดหมวดหมู่ จัดทำเป็นชุด หรือสร้างเป็นคลังสินทรัพย์ดิจิทัล เพื่อจำหน่าย แจกจ่าย หรือให้บุคคลอื่นดาวน์โหลดซ้ำ ทั้งในรูปแบบฟรีและแบบเสียค่าใช้จ่าย

4. ห้ามดัดแปลงเพื่อหลีกเลี่ยงข้อกำหนด

ห้ามเปลี่ยนชื่อไฟล์ เปลี่ยนสี ปรับขนาด แก้ไขรายละเอียด แปลงนามสกุลไฟล์ หรือดัดแปลง Asset เพียงเล็กน้อย โดยมีวัตถุประสงค์เพื่อจำหน่ายหรือแจกจ่ายต่อเสมือนเป็นผลงานของตนเอง

5. ห้ามนำไปสร้างคลัง Asset หรือบริการที่แข่งขันกัน

ห้ามนำ Asset ไปเผยแพร่ในเว็บไซต์ ตลาดซื้อขายไฟล์ดิจิทัล แพลตฟอร์มแจกไฟล์ หรือคลัง Asset อื่น เพื่อให้บุคคลทั่วไปเข้าถึง ดาวน์โหลด หรือนำไปใช้ซ้ำในลักษณะที่เป็นการจำหน่ายหรือแจกจ่าย Asset ต่อ เว้นแต่ได้รับอนุญาตเป็นลายลักษณ์อักษร

6. การส่งมอบงานให้ลูกค้า

ผู้ใช้งานสามารถส่งมอบผลงานที่สร้างจาก Asset ให้แก่ลูกค้าได้ โดยต้องเป็นส่วนหนึ่งของผลงานสำเร็จรูป เช่น วิดีโอ ภาพกราฟิก แอนิเมชัน เว็บไซต์ หรือเกม และต้องไม่ส่งมอบไฟล์ในลักษณะที่ทำให้ลูกค้าสามารถนำ Asset ต้นฉบับไปใช้ซ้ำหรือแจกจ่ายต่อได้อย่างอิสระ เว้นแต่ได้รับอนุญาตเพิ่มเติม

7. สิทธิ์ในทรัพย์สินทางปัญญา

การดาวน์โหลดหรือใช้งาน Asset ไม่ถือเป็นการโอนกรรมสิทธิ์หรือลิขสิทธิ์ใน Asset ให้แก่ผู้ใช้งาน ผู้ใช้งานไม่ได้รับสิทธิ์ในการอ้างตนเป็นเจ้าของผลงานต้นฉบับ เว้นแต่มีข้อตกลงเป็นลายลักษณ์อักษรเป็นอย่างอื่น

8. การฝ่าฝืนข้อกำหนด

TDMesh ขอสงวนสิทธิ์ในการระงับหรือยกเลิกสิทธิ์การใช้งานตามความเหมาะสม และดำเนินการตามสิทธิ์ที่กฎหมายกำหนด เมื่อพบการละเมิดข้อกำหนดนี้

9. การยอมรับเงื่อนไข

การดาวน์โหลดหรือใช้งาน Asset จาก TDMesh ถือว่าผู้ใช้งานรับทราบและยอมรับข้อกำหนดการใช้งานนี้ ทั้งนี้ การใช้สิทธิ์ดังกล่าวอยู่ภายใต้เงื่อนไขของใบอนุญาตที่เกี่ยวข้องและกฎหมายที่ใช้บังคับ

TDMesh ขอสงวนสิทธิ์ในการปรับปรุงข้อกำหนดนี้ตามความเหมาะสม โดยจะแจ้งวันที่มีผลบังคับใช้เมื่อมีการปรับปรุง

TDMesh Asset License

Terms of Use

1. Commercial Use

Assets downloaded from TDMesh may be used for personal and commercial projects, including advertising, videos, animations, websites, games, educational materials, graphic design, and finished digital products.

2. No Resale or Redistribution

You may not resell, redistribute, sublicense, share, or otherwise make the original downloaded assets available to others, in whole or in part, without prior written permission from TDMesh or the applicable rights holder.

3. No Asset Bundling or Repackaging

You may not collect, bundle, compile, organize, or repackage downloaded assets for resale, redistribution, or public download, whether for free or for a fee.

This restriction applies to individual assets and collections of assets, including SVG, Lottie JSON, dotLottie, GIF, PNG, and other digital file formats.

4. No Minor Modifications for Resale

You may not modify, recolor, resize, rename, convert, or make minor changes to an asset for the purpose of reselling or redistributing it as your own work or as a separate digital product.

5. No Competing Asset Libraries

You may not use TDMesh assets to create, populate, or operate another asset library, stock asset platform, download website, or marketplace that redistributes the assets or offers them for reuse by others without prior written permission.

6. Client Work and Finished Products

You may incorporate TDMesh assets into finished commercial projects and deliver those projects to clients, including videos, graphics, animations, websites, and games.

However, you may not deliver or distribute assets as standalone files, source files, or reusable asset collections in a way that allows recipients to extract, reuse, resell, or redistribute the original assets independently, unless separately authorized.

7. Intellectual Property Rights

Downloading or using an asset does not transfer ownership or copyright of that asset to the user. You may not claim ownership of the original asset or represent it as your own original creation.

All rights not expressly granted under this license remain with the applicable rights holder.

8. Violations and Enforcement

TDMesh reserves the right to suspend or revoke access to its services, where appropriate, and to pursue available legal remedies in response to violations of these terms, subject to applicable law.

9. Acceptance of Terms

By downloading or using assets from TDMesh, you acknowledge and agree to these Terms of Use and any applicable asset-specific license conditions.

TDMesh reserves the right to update these terms from time to time. Any revised terms will be published with an updated effective date.
